At the end of this session, participants should be able to:
1. Discover how US EPA's revised Definition of Solid Waste (DSW) impacts hazardous waste recycling exclusions
2. Identify RCRA reliefs and exclusions that apply to their facilities and waste streams
3. Navigate and apply the 40 CFR 261 reliefs and keep records of legitimate recycling
Hazardous waste generators that have a deeper understanding of the hazardous waste identification rules are better positioned to make strategic decisions about their hazardous secondary materials, many of which reduce regulatory burdens, including generator status, and possibly operating costs. This session will explore the "Recycling Thought Process” to see how it leads to the 3 levels of recycling relief-not waste, sold waste, and hazardous waste. We’ll examine key definitions and discuss what generators must do to defend their recycling relief claims. This session will discuss reliefs for common materials, such as scrap and precious metals, lead acid batteries, and more.
